This Manual has been prepared in terms of section 51 of the Promotion of Access to Information Act 2 of 2000 (“PAIA”), updated in the light of the Protection of Personal Information Act 4 of 2013 (“POPI”), Financial Advisory and Intermediary Services Act 2002(FAIS Act), Financial Intelligence Centre Act 38 of 2001(FIC Act),  Treating Customer Fairly (TCF), National Credit Act (NCA) and the Prescription Act

Purpose of PAIA

PAIA act was passed to give effect to the constitutional right, held by everyone in South Africa, of access to information which is held by the State or by another person and which is required for the exercise or protection of any right. Where a request is made in terms of PAIA, the body to which the request is made is obliged to give access to the requested information, except where the Act expressly provides that the information may or must not be released.

It is important to note that PAIA recognises certain limitations to the right of access to information, including, but not exclusively, limitations aimed at the reasonable protection of privacy, commercial confidentiality, and effective, efficient and good governance, and in a manner which balances that right with any other rights, including such rights contained in the Bill of Rights in the Constitution.

POPI was enacted in November 2013, to promote the protection of personal information processed by public and private bodies. POPI amended certain provisions of PAIA, balancing the need for access to information against the need to ensure the protection of personal information.

Purpose of FAIS

The Financial Advisory and Intermediary Services Act, 2002 (FAIS Act), came into operation on 30 September 2004. The purpose of the FAIS Act is to protect consumers of financial services and to professionalise the financial services industry. To achieve this, the FAIS Act imposes certain requirements on providers of financial services to ensure that consumers receive proper financial advice, that they are provided with sufficient information to make informed investment decisions and that they are dealing with fit and proper advisors and intermediaries.

Purpose of FICA

The purpose of FICA is to combat money laundering activities by, among other things, establishing a Financial Intelligence Centre and imposing certain duties on institutions and other persons that might be used for money laundering purposes.

These persons/institutions are identified as “accountable institutions” in the Act. The Financial Intelligence Centre Act (38 of 2001) (the FIC Act) came into effect on the 1st of July 2003.

Purpose of TCF (as per Financial Services Board of South Africa)

Treating Customers Fairly (TCF) is an outcomes-based regulatory and supervisory approach designed to ensure that specific, clearly articulated fairness outcomes for financial services consumers are delivered by regulated financial firms. Firms are expected to demonstrate that they deliver the following 6 TCF Outcomes to their customers throughout the product life cycle, from product design and promotion, through advice and servicing, to complaints and claims handling – and throughout the product value chain:

  • Customers can be confident they are dealing with firms where TCF is central to the corporate culture
  • Products & services marketed and sold in the retail market are designed to meet the needs of identified customer groups and are targeted accordingly
  • Customers are provided with clear information and kept appropriately informed before, during and after the point of sale
  • Where advice is given, it is suitable and takes account of customer circumstances
  • Products perform as firms have led customers to expect, and service is of an acceptable standard and as they have been led to expect
  • Customers do not face unreasonable post-sale barriers imposed by firms to change products, switch providers, submit a claim or make a complaint.

Purpose of NCA

The purpose of the NCA is to promote and advance the social and economic welfare of South Africans; promote a fair, transparent, competitive, sustainable, responsible, efficient, effective and accessible credit market and industry; and to protect consumers while balancing the rights of suppliers.

It applies to all credit agreements between parties dealing at arm’s length that are made in South Africa or have an effect in South Africa. The NCA applies to all natural persons and some juristic persons (in particular small juristic persons). [This includes default credit agreements as a result of pre-agreed payment arrangements – affected by the Prescription Act]

Purpose of Prescription Act

The Prescription Act 68 of 1969 (“PA”) says it means a debt (for example payment of money) is extinguished after the lapse (passing) of a time period.

South Africa has different laws which specify time periods, for example, the PA says contractual and delictual debts extinguish after 3 years from when prescription starts.

The Prescription may be delayed or interrupted.
